Terms and Conditions of Service for the Provision of Audio Broadcasting and SMS Subscription

This service is only available to users of UK mobile phones on the following networks – O2, Vodafone and Orange
The Subscriber Agrees that:
1. By subscribing to the Wisden V2M update service by way of your mobile phone you are agreeing to receive calls to your mobile phone on the morning following the previous day's play in the Ashes cricket tour in Australia.
2. The broadcast is intended to be made at between 0830hrs and 0930hrs but may vary according to the actual finishing time of the match.
3. All subscription requests must be received by 2000hrs on the day before the first V2m message can be broadcast to you.
4. The broadcast will be approximately 2 minutes in length and will include an introduction and a final message within that time.
5. The broadcast is intended to be made to switched on mobile phones and therefore it is the responsibility of the subscriber to ensure that his/her phone is switched on and able to receive incoming calls. The broadcast is made in such a way as to activate voicemail on switched off phones although it is likely that part of the audio will be missed in this case. Wisden take no responsibility for loss of audio where voicemail is activated.
6. Inability by the subscriber to receive the V2M service by reason of failure of personal phone equipment will not relieve the subscriber from charges by Wisden.
7. By subscribing through the provided SMS short code as advertised you are agreeing to be billed £1.50 incl. VAT for each call that is made to your mobile phone.
8. You will receive a maximum of 25 calls during the period covered by the Ashes tour and therefore the total cost of this service could be £37.50 incl. VAT. The exact number of calls you receive will depend on when you subscribe and the final outcome of the tour.
9. The cost of subscription is not inclusive of the cost of sending your first subscription request and may vary between networks and individual tariffs.
10. The method of billing is through Reverse Billing SMS and as such you will make your payment by having £1.50 deducted from your phone bill on each separate occasion. This is done by sending an SMS to your phone each time you receive your V2M call from Wisden
11. The service will continue until either you have received all messages available up to the end of the tour or until you unsubscribe from the service, whichever is the sooner.
12. In-order to unsubscribe from the service you are required to send a text message to 89080 with the words `Times unsubscribe' for subscribers through The Times newspaper or `Sun unsubscribe' for subscribers through The Sun newspaper. Once you have chosen to unsubscribe you will be removed from the service and will receive no more V2M messages and all further charges will cease with immediate effect.
13. Should you wish to make a comment or complaint about any part of this service then please direct your correspondence in writing to : The Marketing Manager, Wisden Online, 136 Bramley Road, London W10 6SR or email helpdesk@wisden.com. All comments or complaints will be dealt with promptly.
14. Please note that as this service is provided via public networks Wisden cannot be held responsible for any failure in the provision of this service due to failure on public networks.
15. By subscribing to this service you are agreeing to allow Wisden Online and related Wisden companies to communicate with you via SMS for the purposes of marketing of selected services that we feel would be of interest to you.
16. Neither the subscriber nor Wisden shall be liable in respect of any breach of this agreement due to causes beyond its reasonable control including but not limited to Acts of God, inclement weather, flood or escape of water, lightening or fire, industrial action, or lockouts or omission of Government, any Regulatory Body or other competent authority, war, military operations, or riot or congestion or non-operation of the Vodafone, Orange, O2 networks and the Public Networks or any of them.
