Miller appeal dismissed

The Australian Cricket Board (ACB) Appeals Committee today dismissed the appeal by Colin Miller for a transfer from Tasmania to Victoria.
Chairman of the three member Appeal Committee, Judge Gordon Lewis, said that the decision to refuse the appeal took into consideration Mr Miller's personal circumstances.
"Weighing up all the relevant matters, including Mr Miller's personal circumstances, we are not prepared to exercise our discretion to abridge the residential period or grant him an unconditional transfer at this time," said Judge Lewis.
Earlier this month Mr Miller had sought a transfer to Victoria from Tasmania but was refused permission by a majority of the State Associations.
In accordance with the ACB rules, Mr Miller appealed this decision and the Appeal Committee was convened to hear the matter. The committee comprised Judge Lewis, prominent Melbourne barrister, Tony Nolan, and a nominee from the Australian Cricketers' Association, Victorian solicitor, John Adams.
While dismissing the appeal, Judge Lewis did indicate that under the ACB Rules Mr Miller, who leaves for Sri Lanka and Zimbabwe with the Australian team today, will have the opportunity to revisit his application for a transfer when he returns from the tour in October.
